Mistrial ends fraternity case after jury deadlocks

..."They were deadlocked on the second question," Alden said, which would have decided how much each party was to blame for. If the jury decided Holloway was more than 50 percent at fault then he would receive no recovery from the fraternity.

"It was a six-and-six split, and they never wavered," said James Ewbank, one of the fraternity's attorneys. Ewbank said six of the jurors believed Holloway should take most of the blame, and six of the jurors decided the blame was equal or that it was ATO's fault...

A mistrial was declared Monday in a lawsuit against a University of Texas fraternity filed by Wes Holloway, a former member who was paralyzed after he belly-flopped from a picnic table into a shallow pool in 2003.

The jury in the case against the Austin chapter of the Alpha Tau Omega fraternity deadlocked...

Jim Ewbank, a lawyer for the fraternity, said: "We're disappointed in the verdict. We anticipate that in a retrial of the case that we will in fact prevail."...

Foam frenzy, rush revelry

Bikers Extravaganza

The Bikers Extravaganza Poker Run will be held Sunday, September 11th, 2005 and is sponsored by the March of Dimes Bikers for Babies and Alpha Tau Omega Fraternity. The Poker run starts at the March of Dimes, Jonesboro office, 272 Southwest Drive, with the first bike out at noon and the last out by 1 p.m. The run fee is $5 per hand.

The Biker Extravaganza starts around 5 p.m. at the Arkansas State University pavilion. There will be a bike wash, bike games, live music, games for the kids, and more. Admission: $3 per person, children 9 and younger free. Those who participate in the poker run also get in free. Proceeds benefit the March of Dimes Bikers for Babies. (870) 932-0300.



Verdict expected today in fraternity lawsuit

A UT student who claims his paralysis is the result of his fraternity's negligence at a 2003 party will likely hear a verdict today. Wesley Holloway was mostly paralyzed after belly-flopping into a makeshift pool.
Holloway, an undeclared natural sciences junior, claimed his state of paralysis is partially his own fault, but his former fraternity, the Austin chapter of Alpha Tau Omega, should share some of the blame...

Todd Wallace, another fraternity alumnus who is a builder with Verizon Construction in Memphis, Tenn., said the new house will look very similar to the old one. As a former member of the Ole Miss ATO chapter, Wallace said rebuilding the house holds "more special to my heart than other jobs for sure. And it gives me a closer connection to the chapter itself by being involved like this"...

Max Miller of Oxford, an ATO alumnus who is involved in the rebuilding process, said the house is set to be completed by August 2006. "They are preparing now to lay the foundation, which will be constructed in the next few days," he said last week. "As of right now, the final cost is not calculated, but our goal is to allow the students to move in fall of 2006."...

Alcohol 101 Now A Required Course As Colleges Battle Binge Drinking

In an effort to curb binge drinking by college coeds, more universities are requiring incoming students to complete an online alcohol-education course...

Greek organizations are also starting to require new members to enroll in the AlcoholEdu course. In September 2002, Kappa Alpha Theta, one of America's largest sororities, announced that it would start mandating alcohol education for all of its 12,000 members in more than 120 chapters across the U.S. and Canada. Other Greek organizations have since followed suit, including fraternities Delta Phi, Sigma Nu and Alpha Tau Omega.

"Foam parties were not allowed to take place at the ATO house, so we didn't discuss it with alumni," testified Travis Holloway, who at the time was Alpha Tau Omega fraternity's assistant pledge trainer...

Former frat member testifies about paralyzing belly-flop

Wes Holloway testified in court Wednesday that the belly-flop he took into a wading pool at a fraternity party that left him mostly paralyzed was partially his fault. But some responsibility also lies with the fraternity he is suing, he said.

The trial in the lawsuit against the Austin chapter of the Alpha Tau Omega fraternity began this week... Holloway, 21, is seeking $25 million for the May 2, 2003, incident...

Delaware Fights Jewish Fraternity's Suit Against Discrimination

..."This one is unique," said Richard McKaig, dean of students at Indiana University in Bloomington and director of the Center for the Study of the College Fraternity. McKaig said he has never seen a fraternity attempt to be readmitted by claiming religious discrimination in the 34 years he has spent studying the organizations.

Seven University of Delaware [web/tickets] fraternity chapters... are currently suspended, and one is on probation, school spokesman John Brennan said...

The university also faces a suit from Alpha Tau Omega fraternity, which claims its rights were violated when the school ordered it shut down in February. The organization was accused of failing to properly supervise guests at a September 2004 party...

In March, the university upheld a guilty ruling and resulting four-year suspension of the Alpha Tau Omega fraternity... The fraternity was found guilty of charges including failing to ensure guests' safety at a party, exceeding legal occupancy limits at the house and violating university and city alcohol laws...
